Terms & Conditions

www.highendheadphones.co.uk are operated by HiFi Lounge Limited and references to ‘we’, ‘us’ and ‘our’ shall be deemed as references to Highend Headphones. References to ‘you’ and ‘your’ shall be deemed as references to any person placing an order via www.highendheadphones.co.uk and via telephone order.

 

Orders

When you place an order with us it will be deemed that you have read, understood and agreed to these Terms & Conditions. If you are unhappy with any part of these terms and conditions, you should contact us before placing an order. We require your name, email address, credit/debit card, phone and address details. A contact phone number is needed so that we can get in touch if there is a problem with your order, we may pass this number onto our courier to help with the delivery of your order. If you have provided us with your email address we will send you a confirmation of your order. Please note this is not confirmation that your offer to buy the items has been accepted. Our contract for the sale of our products will only exist once an order has been accepted, processed and despatched to you. Please note you will be charged at the time of placing your order. Our Privacy Policy sets out the terms on which we process any personal data we collect from you.

We reserve the right to refuse an order. Non acceptance of an order may be as a result of one of the following: the product being out of stock; our inability to obtain the authorisation of payment; the identification of an error within the product information, including price and promotion; and you not meeting the eligibility to order as set out in the Terms and Conditions. The terms of your order will be made available to you on request via email to info@highendheadphones.co.uk, we advise you to print off and retain confirmation of the order for your records.

Unfortunately we may find that an item is not available for immediate delivery after you have placed your order due to supplier stock levels and certain products that are built to order. We will notify you of delivery timescales for your order in your confirmation e-mail.

Sometimes, we may offer a pre-order facility for an item that we are awaiting delivery on, an estimated timescales of delivery will be provided in your confirmation e-mail and we will notify you via email once the stock has arrived in.

Some of our items will be dispatched to you directly from our suppliers which may result in you receiving more than one package for your order.

Highend Headphones reserve the right to change the prices of our products at any time. Much effort is put into making sure all information and pricing is correct.

If a pricing error is identified on an advertised product before an item is shipped, Highend Headphones retains the right to offer the customer a full refund or the opportunity to purchase the item at the correct selling price.

 

Payment

When ordering products from the highend Headphones website we can only process your order when the goods ordered have been paid for in full by credit or debit card. You can pay on-line with all major credit and debit cards. Your payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be charged for items at the point of order. Our liability to you in connection with any order will not exceed the total price charged for the relevant items. We accept internet orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, Mozilla Firefox, Apple Safari, Internet Explorer, Google Chrome or other popular browsers. This means you cannot inadvertently place an order through an unsecured connection.

 

Acceptance

We have the right to cancel your order if:

  1. We have insufficient stock to make and deliver the goods ordered.
  2. If you have ordered from an island or country where we do not deliver.
  3. The goods ordered unbeknown to us have been discontinued.
  4. A pricing error or typing error has occurred due to system failure within our database or website.

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. No discounts or compensation can be offered under these unforeseen circumstances.

 

Delivery

We only ship to the UK and orders from outside the UK will unfortunately have to be refused. Please contact your local distributor.

We use a range of different delivery options to get your order out to you as quickly as possible. Whilst we do our best to carry a large range of items in stock obviously this can prove quite difficult at times but we do our very best to offer a next day service. We are not a online warehouse rather we are an established retailer with premises you can visit for excellent demonstration facilities and customer service. Many of the headphone distributors are willing to ship next day direct to our customers.

Certain brands such as Stax and Bryston build their products to order so this can often lead to a longer delivery period. If you would like to check the stock status of any products please feel free to get in touch and we can give you the latest availability on the products you are interested in. As part of the order process we will keep you informed of delivery timescales and keep you updated once we receive further information.

The following services are based on a best endeavour basis and are not guaranteed.

Standard delivery takes between 3 and 5 working days and is delivered by UPS although we may occasionally use different couriers.

All deliveries are subject to the couriers Terms and Conditions.

We deliver to Mainland UK, Non mainland UK (Jersey, Guernsey, Isle of Man), Ireland and Highlands of Scotland.

Unfortunately, we do not deliver outside the UK or to PO Boxes at all.

Returns and Exchanges

Highend Headphones wants you to be completely satisfied with your new purchase. Should you change your mind and wish to return an item, we will be happy to exchange the product (with the exception of certain items such as in ear phones and IEM’s ‘which by their nature cannot be returned’) or offer a full refund subject to the following:

If you wish to return sale items you must notify us of this within 7 working days from receipt of your package. You must return the products to us at your own cost.

The goods returned must be in 'as new' condition and returned in the original, undamaged packaging along with accessories and any free gifts received with it. We can not provide a purchase, test and return service without charging a fee for demonstration. Therefore any product returned not ’as new’ will be subject to a 20% returns fee as this product will now be classed as ex demo. We are an established retailer with premises you can visit for excellent demonstration facilities and speak to us about your requirements before purchasing so we can ensure you purchase the right product for you.

You are responsible for the items until they are received at the return address and thus we advise customers to request a free certificate of posting or receipt from the post office or courier and retain this until receipt is confirmed by us.

In the unfortunate circumstance where an item has arrived faulty or damaged you should contact us as soon as possible.

Where an email address is provided we will confirm any cancellation or refund by email, you should expect your refund within 10 working days from dispatch of your returned items.

Delivery charges from the original order will be refunded only where an entire order is returned. This does not affect your rights to claim for defective or faulty goods or workmanship under the Sale of Goods Act 1979 (as amended) or the Supply of Goods and Services Act 1982.

Cancellations

You have a legal right to cancel your order within 14 working days of receipt of the goods. You may not return products if they have been damaged (in our reasonable opinion) as a result of fair wear and tear, deliberate damage, accidental damage (by you), negligence, abnormal working conditions, failure to follow manufacturer instructions, misuse or alteration or repair of the goods without manufacturer approval.

Please notify us as soon as possible if you want to cancel your order, we will do our best to stop the order from being sent to you but in some cases will be unable to do so. In these cases you should either reject the order at point of delivery or you will have to return the item to us at your own cost. This does not affect your statutory rights.

If you wish to cancel your order you must return the products to us at your own cost. General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. We will never pass your details on to any third party without your express permission. We will give you the chance to refuse any marketing email from us in the future.

The type of information we will collect about you includes:

  • Your name, delivery and billing address
  • Your telephone number (so that we can contact you if there is a query on your order)
  • Email address (so that we can send you order confirmation and shipping updates – we will never share your email address with another party)

We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

The personal information which we hold will be held securely in accordance with our internal security policy and the law.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings. Disclaimer & Limitations of Liability

Highend Headphones does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation. To the fullest extent permitted by law and save as provided above, neither Highend Headphones nor any associated company shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Highend Headphones or any of its members, agents, directors, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or loss of saving), costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.
